Costs and Fees Encyclopaedia: SI 2020/903 changes

The Criminal Legal Aid (Remuneration) (Amendment) Regulations 2020 (SI 2020/903) amended the Criminal Legal Aid (Remuneration) Regulations 2013, with effect from 17 September 2020 (except for regs 3 and 6 which came into force on 19 October 2020). They made provision for payments in respect of the consideration of unused material under both the advocates’ graduated fee scheme (as set out in Schedule 1) and the litigators’ graduated fee scheme (as set out in Schedule 2). Provision was also made in relation to fees payable for special preparation under the advocates’ graduated fee scheme. The Regulations also amended the advocates’ graduated fees scheme in respect of payments for cases where there is a guilty plea or a cracked trial, and amended Schedule 4 to provide the amount of a fixed fee in relation to work undertaken in a case sent from the magistrates’ court to the Crown Court for trial.
