Where claimants had succeeded at trial against the first defendant and the parties had agreed to discount the claimants' costs otherwise payable by the first defendant to take into account the unsuccessful claim against the second defendant, it was appropriate to consider all issues of the case in the round when deciding the appropriate level of discount.
